Report submitted by two members of the academic staff in October 2019, pursuant to article 18, paragraph 1, of the Code of Ethics, regarding an alleged violation of the Code of Ethics.

Opinion: Over the past months, the Committee - to keep the identity of the reporter and those mentioned in the reports confidential, to guarantee the right to defense and the right of the other party to be heard, as provided for in article 18, paragraph 4, of the Code of Ethics - has conducted various hearings and carefully examined many documents.

The Committee unanimously agree that there has not been any violation of the Code of Ethics of the University and in particular of article 6 "Respect for the person", and has therefore decided to close the case.

Question: a student realized, during an online exam, that a message from one of the members of the exam committee on the Zoom group chat, clearly referred to them. The student was extremely upset by the message, which was almost immediately deleted, and failed the exam.

Opinion: the Committee, having examined the documents provided, held a hearing with the author of the message on the Zoom group chat. During the hearing, which was held remotely, the author of the message expressed their regret for the impact of the message and offered their apologies.

The Committee recalls that, based on current jurisprudence, the discriminatory effect of an action remains even when such effect was not the real intention of the person carrying out that action.

The Committee for the implementation of the Code of Ethics has learned that its recommendation to the author of the message to personally offer an apology to the student has been accepted and the two have met. The meeting was successful, the controversy has been resolved and the case has been closed.
