This section provides guidelines and operating procedures for exercising the right of access vis-à-vis the University of Trento pursuant to the following:
- The Regulations on access to University documents and data, issued on 9 August 2018, that you can find at the bottom of this page;
- Law No. 241/1990, "Nuove norme in materia di procedimento amministrativo e di diritto di accesso ai documenti amministrativi" (New rules on administrative procedure and the right of access to administrative documents);
- Presidential Decree No. 184/2006, "Regolamento recante disciplina in materia di accesso ai documenti amministrativi" (Regulations containing provisions on access to administrative documents);
- Legislative Decree No. 33/2013, as amended by Legislative Decree no. 97/2016 "Riordino della disciplina riguardante il diritto di accesso civico e gli obblighi di pubblicità, trasparenza e diffusione di informazioni da parte delle pubbliche amministrazioni" (Reorganisation of regulation concerning the right of civic access and the publicity, transparency and dissemination of information of public administrations).
Types of access to documents
There are three different types of access to documents:
- “Documental access” can be exercised by anyone who has a direct, concrete and current interest, corresponding to a legally protected situation and connected to the document for which the access is requested and governed by Law No. 241/1990;
- “Simple civic access” may be exercised, pursuant to Legislative Decree No. 33/2013, to request that documents, information or data subject to mandatory publication that the University has failed to publish be published online;
- “Generalized civic access” can be exercised to obtain data, documents and information held by the University, in addition to those subject to publication requirements pursuant to Legislative Decree No. 33/2013.
Documental access, provided for by Chapter V of Law No. 241 of 7 August 1990 (Article 22 et seq.) and by Presidential Decree No. 184 of 12 April 2006, concerns the right of the data subjects to view and obtain copies of administrative documents held by public administrations.
The application for access to documents can be submitted informally (if there are no other data subjects with an interest in accessing the documents, there are no doubts about the legitimacy of the applicant and it is possible to grant the request immediately); or formally, by filling out and submitting the form below and attaching an identification document.
Anyone with a direct, concrete and current interest, corresponding to a legally protected situation and connected to the document for which the access is requested, can apply for access. For this reason, the request must indicate the interest in viewing or extracting a copy of the document. The administration will assess, on the basis of the reasons given, whether the applicant has a direct, concrete and current interest in viewing the document. The applicant must indicate the documents they are interested in. The examination of documents is free of charge. The provision of copies is subject to reimbursement of the cost of production, without prejudice to the provisions in force regarding stamp duty. The University is not bound to produce documents that are not already in its possession at the time of the request. Access is granted in accordance with the limits and criteria set by Law No. 241 of 7 August 1990, Presidential Decree No. 184 of 12 of April 2006 and the Regulations on access to University documents and data (available in the relevant section below).
The request for access shall be submitted by:
- ordinary mail to the competent Office or to: University of Trento, Via Calepina 14, 38122, Trento.
- e-mail to the competent Office or to: [email protected]
- certified e-mail (PEC) to: [email protected]

The competent office holding the documents, information or data included in the request for access shall assess the completeness, correctness and validity of the request, and notify the applicant of the partial or total refusal or granting of the request within 30 days. This is without prejudice to the notification obligations and the possible exercise of the right of opposition by any third parties with an interested in opposing the request for access (in this case, those parties are granted 10 days to submit any objection).
In the event of express or implied refusal of access, or of a deferral of access, the applicant may lodge a complaint with the Regional Court of Administrative Justice within 30 days, under Article 25 of Law No. 241 of 7 August 1990.
Simple civic access, introduced by article 5 (1) of Legislative Decree No. 33 of 14 March 2013, is the right of anyone to request documents, information or data, that are subject to mandatory publication according to the regulatory provisions in force, in the case where the public administrations have failed to publish them.
The request for simple civic access is free of charge, does not need to be motivated, and must identify as precisely as possible the data, information or documents whose publication is requested. The request is valid only in cases of failure to publish online acts, documents and information as required by law.
The request for simple civic access can be submitted to the head of the Transparency Office of the University of Trento using the online form or the form below, in this case attaching a personal identification document via:

The head of the Transparency office, upon receipt of the request, assesses its correctness, completeness and validity, and provides for their publication, through the competent Office that holds the documents, information or data subject to the request for access, within 30 days. He or she also simultaneously informs the applicant of the publication, indicating the hyperlink (URL) to which they were published.
In the event of refusal, delay or lack of response by the head of the Transparency office, the applicant may appeal to the Director General by email to [email protected].
Generalized civic access, introduced by art. 5 (2) of Legislative Decree No. 33 of 14 March 2013, is the right of anyone to request documents, information and/or data in addition to those subject to mandatory publication, in compliance with the limitations relating to the protection of legally relevant public and private interests, as provided for by article 5 bis of the aforementioned legislative decree.
The request for generalized civic access does not require a motivation, must identify the documents or data requested and is free of charge, except for reimbursement of the costs actually incurred by the administration for reproducing the documents on physical media. The University is not required to produce documents, information or data that are not already in its possession at the time of the request.
The request for generalized civic access is submitted to the competent office that holds the documents or data subject to the request, preferably using the online procedure.

The competent office that holds the documents, information or data subject to the request for access shall assess their completeness, correctness and validity by notifying the applicant of the partial or total refusal or acceptance of the request within 30 days, without prejudice to the communication obligations and the possible exercise of the right of opposition by any counter – interested parties to the request for access (in this case, the interested party is granted 10 days to submit possible opposition).
In cases of total or partial denial, delay or lack of response from the competent Office, the applicant may submit a request for review to the Corruption Prevention Officer at the [email protected] email who responds with a reasoned decision within 20 days.
